Terms of Service: ContractorRenders

1. Agreement and Acceptance of Terms

By accessing, browsing, or utilizing any professional services, platforms, or tools provided by ContractorRenders ("Company", "we", "us", or "our"), including but not limited to photorealistic rendering, proposal design, and our contractor portal, you agree to be legally bound by these Terms of Service. If you do not agree to these terms in their entirety, you are unauthorized to use our services or platforms.

2. Scope of Services

ContractorRenders delivers done-for-you visual sales tools for pool, patio, and outdoor living contractors, which encompass:

Photorealistic rendering of proposed projects based on customer photos and project specifications submitted through our contractor portal.
Design and assembly of branded, shareable proposal pages and documents, including pricing, project timelines, and renders.
Access to a contractor portal for submitting jobs, tracking render status, and managing your render asset library.

We retain the absolute right to update, modify, enhance, or deprecate features of our services or platform at our sole discretion without prior notice.

3. Client Obligations and Responsibilities

To ensure optimal performance, clients utilizing our services agree to:

Furnish timely, accurate, and complete project photos, specifications, pricing, and any other assets required to produce a render or proposal.
Maintain prompt communication and provide necessary approvals or revision requests within a reasonable timeframe.
Use renders and proposals only for legitimate sales purposes with your own customers, and not misrepresent a render as a guarantee of final built appearance.
Only submit photos and project details you have the right to use, and that do not infringe on any third party's rights.

You explicitly agree not to abuse our systems or utilize our infrastructure for any deceptive, predatory, harmful, or unlawful business activities.

4. Billing, Fees, and Payment Terms

Unless alternative payment structures are explicitly detailed in a separate written agreement, all services are structured on a monthly subscription and billed in advance.

Invoices are due and payable immediately upon issuance.

Failure to clear outstanding invoices within the designated timeframe may result in an immediate suspension of render production, proposal delivery, and active access to your contractor portal.

5. Intellectual Property Rights

All rendering techniques, proprietary workflows, proposal templates, and design systems produced by ContractorRenders remain our exclusive intellectual property unless ownership is explicitly transferred to the client via a signed written agreement. Clients retain full ownership of their submitted project photos, business data, customer lists, and finished renders and proposals delivered to them for their own sales use.

6. Confidentiality Mutual Covenant

Both parties agree to protect and maintain the strict confidentiality of all proprietary business operations, data metrics, private strategies, and internal systems revealed during the duration of our partnership. Confidential data will not be disclosed to any outside third parties unless authorized in writing or compelled by a court of law.

7. Digital Communications and SMS Compliance

ContractorRenders utilizes established third-party communication infrastructure to deploy automated SMS and email alerts for internal operational updates, render status notifications, and account management.

By engaging our services, you consent to receive these automated communications.

All phone numbers handled through our platform are managed in strict compliance with current A2P 10DLC registration guidelines and carrier regulations.

For any automated texts received from us, you can reply STOP at any time to opt out, or HELP for technical assistance.

8. Liability Limitations and Disclaimer

ContractorRenders provides rendering and proposal design services based on industry best practices. However, we do not guarantee specific financial returns, close rates, or revenue milestones for our clients' businesses. ContractorRenders will not be held liable for any indirect, incidental, special, or consequential damages resulting from platform downtime, delays in render delivery, or the operational use of our services.

9. Contract Term, Commitment, and Cancellation

All ContractorRenders subscription plans (Starter, Pro, and Elite) are billed month-to-month, with no minimum commitment term.

Cancel Anytime: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle, and you will not be charged for any subsequent month. There is no early termination fee.

Termination for Cause: Either party may terminate the agreement immediately if the other party commits a material breach of these terms and fails to cure such breach within fourteen (14) days of receiving written notice.

Trial Guarantee: Where offered, our "first 2 projects free" trial is limited to new clients and may be modified or withdrawn at our discretion.

10. Governing Jurisdiction

These Terms of Service shall be interpreted, governed, and enforced entirely in accordance with the laws of the State of Florida, without regard to principles of conflicts of law. Any legal actions arising from these terms must be filed within the appropriate courts of Florida.

11. Amendments to Terms

We reserve the right to revise or adjust these Terms of Service at any time to reflect service changes, regulatory requirements, or industry adaptations. Your ongoing utilization of ContractorRenders services following the publication of changes signifies your official acceptance of the revised terms.
